Recognition of the Administrative Review Tribunal within the Arrangement

The Administrative Review Tribunal (ART) came into operation from 14 October 2024, replacing the Administrative Appeals Tribunal (AAT). The ART has the same jurisdiction as the AAT, and all existing AAT matters are automatically transferred to the ART from 14 October 2024. 

 

The Hon Ed Husic MP, Minister for Industry and Science on behalf of the Government of Australia and the Hon Andrew Bayly, Minister for Commerce & Consumer Affairs on behalf of the Government of New Zealand have confirmed their mutual recognition of this change in their exchanged letters.

 

The exchanged letters recognise that where the Arrangement for Trans-Tasman Regulation of Patent Attorneys  refers to the “Administrative Appeals Tribunal”, the Governments of Australia and New Zealand understand this to refer to the “Administrative Review Tribunal” as established by the Administrative Review Tribunal Act 2024 (Cth).
